Si quis alicui maiestatis crimen intenderit, cum in huiuscemodi re convictus minime quisquam privilegio dignitatis alicuius a strictiore inquisitione defendatur, sciat se quoque tormentis esse subdendum, si aliis manifestis indiciis accusationem suam non potuerit comprobare. 1. Cum eo, qui huius esse temeritatis deprehenditur, illum quoque tormentis subdi oportet, cuius consilio atque instinctu ad accusationem accessisse videbatur, ut ab omnibus commissi consciis statuta vindicta possit reportari. The Emperor Constantine to Maximus, Prefect of the City. If one person should accuse another of the crime of treason, he who is accused, no matter what his rank or privileges may be, cannot protect himself from torture, and whoever brings the accusation is hereby notified that he also shall be put to the question (if he should be unable to prove his charge by convincing evidence) along with the person accused of a crime of this kind. He also, by whose advice and instigation the accusation appears to have been made, must be subjected to torture, in order that punishment may be inflicted upon all persons guilty of complicity in the offence. L'empereur Constantin à Maxime, préfet de la ville. Comme lorsqu'il s'agit de crime de lèse majesté, l'accusé ne peut en aucune manière, quelle que soit sa dignité, éviter les tourmens de la question ; que pareillement l'accusateur sache qu'il doit lui-même y être soumis avec celui qu'il accuse, s'il ne donne pas des preuves suffisantes de son accusation. On doit également soumettre à la même épreuve celui par le conseil et l'instigation de qui l'accusation a été faite, afin qu'on tire une égale vengeance de tous les complices du crime. Fait pendant les calend. de janvier, sous le consul. de Volusien et d'Annien.
